In France, family law provides a framework to manage the legal aspects arising out of the relationships between two or more people who are married or in a civil partnership, or are related to each other.

Family law cases are heard by a specialist family law judge. These include, divorce, family matters arising from divorce, for example, questions of maintenance obligations, the liquidation of the matrimonial regimes of the spouses, parental responsibility, guardianship of minors, civil partnerships (PACS) and the procedure for changing surnames, first names, etc.

It is now possible to divorce by mutual consent using a procedure that doesn’t involve a judge. Each of the spouses are represented by their own lawyers who draw up the divorce agreement and the final agreement is registered with a notaire.
