Commercial and residential leases

You can prevent disputes between landlords and tenants by ensuring any rental contract is sufficiently detailed and has reasonable terms. However, disputes may arise. If so, I can help you deal with breach of contract by landlord or tenant, violation of your rights as a tenant, non-payment of rent or recovery of property occupied by others.

Request an annullment of an AGM of a Copropriété

A general meeting of members of a copropriété must be held annually and must follow certain procedures for its decisions to be valid. If it doesn’t, it is possible to challenge the decisions adopted. Co-owners who wish to contest have two months from receipt of the minutes to do so, so it is important to seek legal advice quickly.

Easements and rights of way

Rights of way and easements (servitudes) are often the source of neighbour disputes. It may be that one neighbour is trying to revoke a right of way over their land. Or, one is failing to meet their responsibilities under the terms of an easement. It is best to try to resolve neighbour disputes amicably, to avoid costly or lengthy legal proceedings and tension between you. However, this is not always possible, and sometimes the case will need to go before a judge. It is, therefore, important to obtain the appropriate legal advice at an early stage when dealing with disputes over easements or rights of way.

Hidden Defects (vices cachés)

Property law provides a remedy for vices cachés. These are defects in a property which were not apparent at the time of purchase and which have a significant impact on your use of the property. However, these cases can be very difficult to prove and a number of conditions must be met for a claim to be successful. If you are considering legal action for a hidden defect, seek legal advice as soon as possible. To be able to take legal action, you must formally declare the defect to the seller within two years of its discovery.
